JJLM attorneys were successful in defeating Temple University Health System’s efforts to have Plaintiffs Pennsylvania Wiretapping and Electronic Surveillance Control Act (“WESCA”) and negligence claims thrown out. Plaintiffs sued Temple University Health System (“TUHS”) for negligence and violating WESCA for allegedly conspiring with Adobe, Inc. to enable Adobe to intercept Protected Health Information and Personally Identifiable Information through TUHS's website. Pennsylvania State Court Judge James C. Crumlish, III, held that because Plaintiffs alleged that TUHS intercepted their information in violation of WESCA and because Plaintiffs adequately alleged that Adobe intercepted the contents of their communications, Plaintiffs have standing and sufficiently alleged a WESCA claim. Judge Crumlish also held that Plaintiffs sufficiently alleged that TUHS owed them a duty of care to protect their personal information, that TUHS breached that duty, and that Plaintiffs suffered damages.
